Fathers and Football, a Texas nonprofit corporation (“FAF,” “we,” “us,” “our”), documents its programs, events, clinics, and games through photography, video, and audio recording. This release and consent form describes how that media may be used and constitutes a binding agreement between you (the signing party) and FAF.
FAF and its authorized representatives (including contracted photographers, videographers, and volunteers) may photograph, film, or otherwise record participants during any FAF-sponsored or FAF-affiliated program, event, or activity, including but not limited to practices, clinics, combines, games, scrimmages, tournaments, community events, fundraisers, and award ceremonies. All photographs, video recordings, audio recordings, and any derivative works created from them are referred to collectively as “Media” in this release.
By signing this release, you grant FAF a perpetual, irrevocable (except as provided in Section 5), royalty-free, worldwide, non-exclusive license to use, reproduce, distribute, display, and create derivative works from Media in which the participant or adult signer appears, including the participant’s or signer’s name, image, likeness, and voice as captured in that Media, for any lawful nonprofit purpose, including but not limited to:
FAF will not sell Media to third parties. FAF may identify a participant by first name, age division, team name, and/or jersey number, but will not publish a minor’s last name, home address, school name, phone number, or email address without separate written consent from the minor’s parent or legal guardian.
Consent under this release is voluntary. No payment, fee, royalty, or other compensation of any kind will be provided to the participant, parent, guardian, or any other person in connection with the capture or use of Media under this release. By signing, you waive any right or claim to compensation, damages, or injunctive relief arising out of FAF’s use of Media as described in this release, except for uses that materially exceed the scope described in Section 2.
You waive any right to inspect, review, or approve any finished Media, any printed or digital material that may include Media, or any copy, caption, or text used in connection with Media.
You may revoke this consent at any time by sending written notice (email is sufficient) to [email protected] identifying the participant by name and requesting that FAF stop future use of their Media.
On receipt of a valid revocation request, FAF will use commercially reasonable efforts to stop using the identified participant’s Media in new materials going forward. However, revocation applies prospectively only. FAF is not obligated to remove, recall, retract, delete, or otherwise take down Media that was published, printed, distributed, posted, shared with sponsors or funders, or otherwise disseminated before FAF received the revocation request. By way of example and not limitation, this includes social media posts already published, printed materials already in circulation, grant reports already submitted, and sponsor packets already delivered.
By signing this release, you acknowledge and agree to this limitation on revocation.
By signing below, you represent and warrant that:
(a) All information you have provided is accurate;
(b) You have the legal authority to sign this release (and, if signing
on behalf of a minor, you are the minor’s parent or legal
guardian with full authority to consent on the minor’s behalf
under Texas Family Code Section 151.001);
(c) No other person’s consent is required for FAF to use Media
as described in this release, or if another person’s consent is
required, you have obtained it;
(d) You have read this release in its entirety and understand its
terms.
This release may be signed in paper form with a handwritten (“wet”) signature or electronically through a third-party registration or document platform (such as Zorts or Accord). An electronic signature, including a typed name, a checkbox acknowledgment linked to the full text of this release, or a signature captured through a digital signing tool, is as binding as a handwritten signature under the Texas Uniform Electronic Transactions Act (Texas Business & Commerce Code, Chapter 322) and the federal ESIGN Act (15 U.S.C. 7001 et seq.).
If any provision of this release is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from this release. The remaining provisions will continue in full force and effect.
This release is governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute arising under this release will be resolved in the state or federal courts located in Collin County, Texas, and the parties consent to personal jurisdiction in those courts.
This release constitutes the entire agreement between you and FAF regarding the subject matter described here. It supersedes any prior oral or written understandings on this topic. This release may not be modified except in a writing signed by both parties.
